Heard in the Central Criminal Court (the ‘Old Bailey’), London

Regina -v- Timothy Parks

We act for the Defendant in this matter.

The Defendant is charged with fifteen (15) counts contrary to section 68(2) of the Customs and Excise Management Act 1979.
The Defendant was the Managing Director of an electronic company called ‘Defendant Electronics Limited.

In the course of his duties, Mr Parks purchased and imported Monolithic Microwave Integrated Circuit (‘MMIC’) components, i.e. ‘Amplifiers’ from the US. Further, Mr Parks then exported the MMIC’s to China and Tiwan. The MMIC Amplifiers were, physically, just integrated circuits, similar to those observed on most electronic circuit boards.

The critical issue in this matter was that the MMIC’s were subject to UK Customs and Excise import/export controls, i.e. an instrument, that sets out that MMIC Amplifier’s with specific attributes require such controls (authorisation) before import and export of the same can be undertaken.


In this matter the instrument control or regulation set out the attributes of the MMIC Amplifier’s of concern i.e. …

a. Rated for operation at frequencies exceeding 3,2 GHz up to and including 6 GHz and with an average output power greater than 4W ( 36 dBm) with a “fractional bandwith” greater than 15%;
b. Rated for operation at frequencies exceeding 6 GHz up to and including 16GHz and with an average ouput power greater than 1W ( 30 dBm) and with a “fractional bandwith” greater than 10%;
c. Rated for operation at frequencies exceeding 16 GHz up to and including 31,8GHz and with an average output power greater than 0,8W(29 dBm) with a “fractional bandwith” of greater than 10%;
d. Rated for operation at frequencies exceeding 31,8 GHz up to and including 37,5 GHz;
e. Rated for operation at frequencies exceeding 37,5 GHz up to and including 43,5 GHz and with an average output power greater than 0,25W ( 24 dBm) with a “fractional bandwith” greater than 10%; or
f. Rated for operation at frequencies exceeding 43,5 GHz;

The fact that Mr. Parks had, according to Mr. Parks, unwittingly imported and exported the MMIC Amplifiers was not in question, yet whether the MMIC Amplifiers Mr. Parks dealt with, fell into the scope where an UK import export license was required.

We, the Defence team led by a leading female criminal QC (at the time), focussed in on the words within the scope of the control, ‘average output power’ and the circumstance that ‘what is the average output power of an Amplifier? Is the average output power of an amplifier ‘set’ as in the wording of the control instrument or is it dependant on other factors, i.e. power input, gain and frequency.

To simplify, on a mobile phone, laptop, audio system the ‘average output of an amplifier’, which fundamentally controls the audio volume of the same is ‘variable’ i.e. not set, so in these circumstances the term ‘average output power’ makes no sense.

In essence, we the defence attempted to argue that the customs control was ‘ambiguous’ and could not be cited as an instrument to convict Mr Parks.
