A man (Claimant) is installing a window frame in the basement of a property.

Aside the aperture where the frame is to be fitted, a low voltage (<1000volt) electric cable enters through the adjacent wall.

The outer mechanical protection of the cable has deteriorated and the inner insulation of the inner copper conductors/cores is exposed (not the copper cores themselves).

When manoeuvring the window frame, an electrical arc flashover manifests from the cable and severely injures the man, leaving the man with life changing injuries.

From photographs, it can be determined to a good degree that the cable is a ‘paper insulated’ type, which is expressed in the Claimants pleadings in the matter as most probably, a ‘Paper Insulated lead Covered Cable’ (‘PILC’).

In the Defence response (to the Claimants pleadings), the Defendants dismiss the PICL cable circumstance and claim the cable is but a ‘PILCSTA’ cable, an acronym for ‘Paper Insulated Lead Covered Steel Tape Armoured’.

In the circumstance, given that due to poor maintenance the outer mechanical protection of the cable was missing i.e. the Lead Covered Steel Tape Armour, then it follows and we argue that the internal attributes of PILC and PILCSTA cables are but the same, i.e. paper insulation which given aging and deterioration of the electrical insulation integrity is prone to manifestation of arc flashovers.

Within the Claimant pleadings, the Claimant alleges that the circumstances, i.e. the missing outer protection and poor maintenance of the cable are a breach of the ‘Electricity Supply Regulations 1988’ (‘ESR’) instrument, i.e. we, the Claimant use this instrument to exhibit a lack of due diligence and care, in other words the negligence of the Defendant.

However, the Defence claim that the ESR Instrument has been revoked and superseded by the ‘Electricity Safety, Quality and Continuity Regulations 2002’ (‘ESQCR’). Duly, the Defence pre-empt the Claimants counter and set out in the Defence that to use the ESQCR instrument, the Defendant will refer additional costs to the Claimant.

On subsequent review by the Claimant (‘us’ ), we identify that at the section ‘General adequacy of electrical equipment’, point 3(1)(b), … states, …

3.—(1) Generators, distributors and meter operators shall ensure that their equipment is

(b) …so constructed, installed, protected (both electrically and mechanically), used and maintained as to prevent danger, interference with or interruption of supply, so far as is reasonably practicable.

So, we as Claimants consider that ‘this is just not cricket’!!! Law is a dirty business !!!
