We act for Man ‘B’, the Claimant in this matter.
Man ‘A’ owns a free hold property and the rights to a convenience store business located within the property, i.e. Man ‘A’ is the ‘landlord’ of the property. Man ‘A’ sells a lease to the business to Man ‘B’ for a price relative to past financial operational costs and profitability of the convenience store business. Man ‘B’ takes up the lease and continues to operate the convenience store business, with similar electrical loads/appliances, i.e. fridges, freezers, coffee machines etc.
After a short while of operation of the convenience store business by Man ‘B’, an engineer visits to change/swop-out the electrical consumption meter associated with the electrical system of the store. However, on inspection of the old meter, the engineer notices the presence of a ‘Liverpool Loop’, i.e. an illicit circumvention of the electrical consumption meter. The engineer discreetly informs Man ‘B’ that a Liverpool Loop exists and that he will depart the store and return at another pre-arranged time to change the meter. In other words, “I haven’t seen the Liverpool loop so remove it and nothing further will come of it”.

Man ‘B’ informs Man ‘A’ (the landlord), that a Liverpool loop exists so Man ‘A’ attends the store and starts to remove the loop. At the time, Man ‘B’ records video stream data of Man ‘A’ tampering with utility company fuses, high current connection blocks (Henley), and manipulating long high gauge electrical cables.
With the presence of the Liverpool loop, the past financial operational costs and profitability of the convenience store business are logically, incorrect ! So, Man ‘B’ proposes to Man ‘A’ that given the financial figures produced at the time of the sale of the convenience store business have been misrepresented Man ‘B’ requests recompense. A dispute arises.
In his defence, Man ‘A’ refutes the presence of a Liverpool loop, and proposes instead that video data stream exhibits him working on the electrical service provisions due to the intermittent tripping a Miniature Circuit Breaker ‘MCB’.
So, you are the judge!
From the video evidence, in all probability was Man A…
(i) Removing an illicit circumvention of the electrical consumption meter, or
(ii) Working on the electrical service provisions due to the intermittent tripping a Miniature Circuit Breaker ‘MCB’
In case (i), illicit extraction of electricity is a criminal offence, should the case be referred to the criminal courts? If so, how would you calculate the amount, fiscal or in electrical energy units, which were stolen, such that a fine or prison sentence commensurate with the latter can be served?
And in respect of business financial misrepresentation, if (i) is deemed to be the case, how would a financial sum be calculated such that the financial attributes of the business at the time of sale can be adjusted to compensate Man B?
